1. VALENCE AND EFFECTIVENESS OF THE GENERAL CONTRACT CONDITIONS

1.1 These general conditions of sale (hereinafter “GENERAL CONDITIONS”) govern the contractual relationship between TORREFAZIONE BUGELLA SAS, based in Italy, via Maestri del Lavoro, 12 13900 – Biella (hereinafter “TORREFAZIONE BUGELLA”) and the customer user of the site (hereinafter “CUSTOMER”) concerning the sale of products marketed by TORREFAZIONE BUGELLA through the website www.torrefazionebugella.it (hereinafter the “SITE”).
1.2 The CUSTOMER may request information, send communications or submit complaints by contacting the TORREFAZIONE BUGELLA customer service, by calling (+39) 015 8353480 or by sending an email to info@torrefazionebugella.it.
1.3 By completing the online order on the SITE and sending the relative confirmation, the CUSTOMER declares to have read and understood the GENERAL CONDITIONS indicated in this document and all the information provided during the purchase procedure, to accept them individually and as a whole. and to oblige to observe them. It is the CUSTOMER’s responsibility and care to print and store or otherwise archive these GENERAL CONDITIONS and the forms reproducing the characteristics of the purchase made. TORREFAZIONE BUGELLA reserves the right to modify these GENERAL CONDITIONS of sale at any time by publishing a new version.
1.4 The online purchase through the SITE takes place on the basis of and in compliance with these GENERAL CONDITIONS, and is allowed only and exclusively to customers resident in Italy. The GENERAL CONDITIONS are valid for purchases made from Italy for products to be delivered in the Italian territory.

2. REGISTRATION, PURCHASES ON THE SITE AND ACCEPTANCE OF THE TERMS OF SALE

2.1 The purchase of all the products in the catalog can be made, through the SITE, after free registration on the same.
2.2 Registration with “username” and “password” is optional. If the CUSTOMER does not wish to register, he can still conclude the purchase: only the data necessary for the delivery and billing of the order will be requested.
2.3 It is not possible to request an invoice for the order once the payment has been completed.
2.4 TORREFAZIONE BUGELLA reserves the right not to accept orders that are anomalous.
2.5 By sending an order on the SITE, the CUSTOMER declares to unconditionally and fully accept the GENERAL CONDITIONS.

3. PRODUCTS, AVAILABILITY AND PRICES

3.1 TORREFAZIONE BUGELLA reserves the right to vary the type and products offered on the SITE at any time, also in relation to availability. TORREFAZIONE BUGELLA does not guarantee that the products presented on the SITE are actually available or that they are within the expected delivery times, as this depends on commercial policies and on the stocks actually present in the warehouse. TORREFAZIONE BUGELLA therefore offers its products for sale within the limits of stock available at the time of receipt of the related purchase order. TORREFAZIONE BUGELLA assumes no liability of any kind for the case of unavailability of products which, although present on the SITE, were not materially available.
3.2 All the images and descriptions of the products published on each product sheet on the SITE reproduce and describe as faithfully as possible the real characteristics of the products.
3.3 It is understood that such images and product descriptions must be considered indicative and interpreted with a minimum of tolerance.
3.4 The prices on the SITE are expressed in euros (€) and include VAT.
3.5 TORREFAZIONE BUGELLA reserves the right to make any changes to prices, updating them on the SITE.
3.6 TORREFAZIONE BUGELLA constantly checks that all prices are correct, without however guaranteeing the absolute absence of any errors. In the event that an error is found in a price, TORREFAZIONE BUGELLA will put the CUSTOMER in a position to reconfirm the purchase of the products at the correct price or to cancel it.
3.7 Vouchers and current promotions cannot be combined with each other.

4. TERMS OF PAYMENT

4.1 Payment for orders can be made:
– through the MultiSafepay portal, by selecting the desired credit card with MasterCard / Visa / Maestro / PostePay / CartaSi circuit;
– through the PayPal platform, by selecting it during the purchase procedure, you will be redirected to the secure PayPal servers;
– bank transfer: by choosing payment by bank transfer, through the MultiSafepay portal, you can easily make the payment from your account. Bank transfer may take 1-2 business days, so your order will not be processed until payment is received.

5. DELIVERY OF PRODUCTS AND SHIPPING COSTS

5.1 The order sent on the SITE will be delivered to the address indicated by the CUSTOMER when placing the order. No deliveries will be made to post office boxes.
5.2 No change in the invoice will be possible after the order has been sent.
5.3 It is important to check the integrity of the package delivered by the courier and in the event of a damaged or abnormal package it is necessary to sign with “subject to control” on the transport document and communicate it to TORREFAZIONE BUGELLA.
5.4 Upon delivery of the goods by the courier, the CUSTOMER is required to check: (1) that the number of packages delivered corresponds to what is indicated in the waybill; (2) that the packaging is intact, not damaged, wet or otherwise altered, even in the closing materials. Any damage to the packaging and / or the product or the mismatch in the number of packages or indications must be immediately notified, placing a written control reserve on the courier’s proof of delivery. Once the courier’s document has been signed, the CUSTOMER will not be able to make any objection about the external characteristics of what has been delivered.
5.5 TORREFAZIONE BUGELLA will notify the CUSTOMER by e-mail within 30 (thirty) days of receipt of the order, should it be unable to deliver the ordered goods following the unavailability, even temporary, of the products. The amount already paid by the CUSTOMER will be reimbursed as soon as possible and in any case no later than 30 (thirty) days from the crediting of the price paid by the CUSTOMER.
5.6 The cost of shipping throughout Italy (including islands) varies according to the number of pieces purchased.
5.7 Delivery takes place by courier, between 24 and 72 hours from the day of shipment, disadvantaged locations excluded. However, these times are to be considered indicative, as they may undergo variations due to force majeure that do not depend on TORREFAZIONE BUGELLA or the carrier.
5.8 Orders received on the SITE on Saturdays, Sundays, holidays or on closing days will be processed on the next working day.

6. CONCLUSION OF THE CONTRACT

6.1 The Contract stipulated between the CUSTOMER and TORREFAZIONE BUGELLA is concluded when the order forwarded by the CUSTOMER reaches the address indicated in the order by the CUSTOMER, provided that (1) the purchase procedure reported on the SITE has been respected, that (2) TORREFAZIONE BUGELLA has received adequate debit authorizations in the manner chosen by the CUSTOMER for payment and that (3) the availability of the PRODUCT has been confirmed by TORREFAZIONE BUGELLA. TORREFAZIONE BUGELLA is not liable for malfunctions of the data transmission network attributable to the manager.
6.2 By sending the order to TORREFAZIONE BUGELLA, the CUSTOMER acknowledges and declares to have read and fully accepted the terms of the contribution for delivery costs, the GENERAL CONDITIONS, the privacy policy and the conditions for exercising the right of withdrawal. .
6.3 The purchase order form will be filed in the SITE database for the period of time necessary to process the orders; TORREFAZIONE BUGELLA reserves the right to keep the purchase order data for statistical purposes and to improve the services offered: the collection of data and their treatment will be exercised according to the terms indicated in the privacy policy.

7. RIGHT OF WITHDRAWAL

7.1 The CUSTOMER will have the right to withdraw from the contract, without any penalty and without specifying the reason, within 14 (fourteen) working days from the date of delivery.
7.2 The right of withdrawal is subject to the following conditions:
– Returned products must be returned in their entirety.
– Returned products must have their original packaging, intact and undamaged.
– The returned products must be sent to TORREFAZIONE BUGELLA in a single solution.
– The returned products must be shipped and delivered to the courier within 10 (ten) working days from the day of receipt of the products purchased on the SITE.
7.3 If the right of withdrawal exercised by the CUSTOMER complies with the conditions listed above, TORREFAZIONE BUGELLA is required to make a refund to the CUSTOMER corresponding to the value of the sum paid within a maximum of 5 (five) days from receipt of the returned material.
7.4 In the event of a return, the costs for returning it to TORREFAZIONE BUGELLA are charged to the CUSTOMER.

9. JURISDICTION AND COMPETENT COURT

9.1 Any dispute relating to the application, execution, interpretation and violation of remote purchase contracts with TORREFAZIONE BUGELLA is subject to Italian jurisdiction.
9.2 These GENERAL CONDITIONS refer, although not expressly provided, to the Legislative Decree 6 September 2005 n. 206. – Consumer Code.
9.3 For any dispute between the parties regarding this contract, the exclusive jurisdiction of the Court of Biella is elected.
